“Animaker Academy” ("Website", “Our”, “We”, “Us”), which is Owned, Maintained and Monitored By Animaker Inc., (“Animaker”) Designs, Develops, Maintains and Offers Certification in Animaker and various other Courseware For The Learner To Sign Up/Register, Pay, Use and Benefit From.
"Content" Refers To The Certification in Animaker and various other Courseware Material Made Available For You, The Learner. Content includes Courseware, Practice Tests, Documents, Data, Material, Information, Products, Videos, Photos, Images, Audio, Music, Sounds, Graphics, Special Effects, Images, Logos, Branding, and Marks.
"Services" shall Mean All Software and Applications, That Allow You To Stream, View or Use The Website, the Content, the Services, and the Courseware.
“Animaker Inc.” is a Delaware Corporation with principal address at 3260 Hillview Avenue, Palo Alto, CA 94304, USA, that governs Your rights to use the Content and Services identified in this Agreement.

Learner Communication: Animaker Academy shares it’s newsletter and promotional communications through email. These email contains information and updates pertaining to Courseware. If a Learner no longer wishes to receive Animaker Academy’s newsletter and promotional communications, Learner may Opt-Out of receiving them by clicking on the “Unsubscribe" link which appears at the bottom of every email We Send You. However, it should be noted that Learners may be unable to Opt-Out of certain important Animaker Academy related communications.
Do We Disclose Any of Your information to Outside Parties?
3rd Party Service Providers:
Yes. Animaker Academy shares Learner's PII with certain trusted 3rd party providers who provide a range of services including: Website Performance Improvement Services, Learner Support Services, Billing Services, Cloud Hosting Solutions, and Analytics Services.
As part of the provision of their services to Animaker Academy, We may transfer some of Learner’s necessary information to them, for them to perform such service.
Animaker Academy has also entered into contracts with such 3rd party providers in order to ensure that the information that is provided regarding Learners is kept confidential and secure.

Right to Access / Right To Rectification
Animaker Academy makes good faith effort to provide Learners with access to Learner's PII for viewing, editing and removal upon request.
Animaker Academy provides Learners the means to edit Learner's PII if it is inaccurate.
Animaker Academy deletes Learner's PII on request, if it is not otherwise required to be retained by law or for legitimate business purposes.
Learners may access, review, correct, update, change or delete their Data at any time.
Learners may access their data using features available within Animaker Academy by signing in to their account to make the desired changes.
Learners may access their data, by contacting Animaker Academy Support team.
Animaker Academy may decline to process Learner's PII access requests that are unreasonably repetitive or systematic, require disproportionate technical effort. For instance, requests concerning Learner's PII residing on backup tapes, jeopardise the privacy of other Learners, would be extremely impractical, or for which access is not otherwise required.
In any case where Animaker Academy provides access and facilitates correction, the service is provided free of charge, except if doing so would require a disproportionate effort.
Please note that if a Learner deletes their Learner Account or Animaker Academy terminates a Learner’s access to Animaker Academy in accordance with Terms of Use, the Learner may no longer have the ability to access or update their Data.
Right to Be Forgotten/Erasure
Learner may trigger an Animaker Academy Account Deletion request by following either of the following processes:
Click on Delete Account button located within their My Account page.
Email Our Support team using the Subject line “Account Deletion”. Animaker Academy will respond to all Account Deletion requests within 30 days. Despite deletion request from a Learner, Animaker Academy may retain Learner's PII for the following reasons:
To comply with a legal obligation.
For public health purposes in the public interest.
For archiving purposes in the public interest.
For scientific research.
For historical research.
For statistical purposes.
For the defense of legal claims.
Right to Data Portability
You have the right to ask Us to provide a copy of Your information to another entity or a service provider, in the event that You wish to move Your account to them.
If You wish to have such a copy, please contact Support Team and We shall provide it to You in an electronic and machine readable form so that You may transmit such information to another entity. If it is technically feasible and should You wish, We will transfer such information directly to such another entity at Your request.
Please be advised We will not be able to provide You with such a copy or transfer such information to such an entity if it would adversely affect the rights and freedoms of other Learners.
Data Sharing:
Animaker Academy does not sell, trade, share or transfer Learner's PII to 3rd parties except in the following limited circumstances:
Animaker Academy may share Learner's PII with Our subsidiaries and affiliates and 3rd party service providers.
Animaker Academy may share Learner's PII for marketing or advertising of Animaker Academy.
Animaker Academy may share Learner's PII with its service providers for direct emailing of its newsletters or notifications of Animaker Academy.
Animaker Academy may share Learner's PII with a 3rd party, after obtaining prior consent from respective Learner(s).
Animaker Academy may share Learner's PII with its partners who offer Animaker Academy to Learners jointly with Animaker Academy.
Animaker Academy may share Learner's PII to process payments.
Animaker Academy may share and/or transfer Learner's PII, if Animaker Academy becomes involved in a merger, acquisition, bankruptcy, or any form of sale of some or all of its assets.
Animaker Academy may share Learner's PII with service providers and government entities to detect, prevent, or otherwise address fraud or security or technical issues.
Animaker Academy may share Learner's PII when it has a good faith belief that access, use, preservation or disclosure of such Learner's PII is reasonably necessary to accomplish the following:
(a) Satisfy any applicable law, regulation, legal process or enforceable governmental request;
(b) Enforce Animaker Academy Terms of Use Agreement, including investigation of potential violations thereof;
(c) Protect against imminent harm to Animaker Academy rights, property or safety, or that of Learners or the public as required or permitted by law;
Animaker Academy may share aggregated or anonymized Learner's PII with 3rd parties for other purposes. Anonymized Learner's PII does not identify Learners individually, but may include usage, viewing and technical data such as the types of Services, Animaker Academy Learners generally use, the configuration of their computers, and performance metrics related to the use of Animaker Academy which Animaker Academy has collected.
Data Security:
The security of Learner's PII is important to Animaker Academy.
Animaker Academy has in place, physical, electronic, and procedural safeguards designed to protect Learner's PII.
Learner's PII like passwords and CVV numbers are encrypted in transit using industry-standard Transport Layer Security (TLS) encryption technology.
All sensitive information, including credit card details, is transmitted via Secure Socket Layer (SSL) technology, and then encrypted into Our payment gateway providers database, which is only accessible to those authorized with special access to each system.
No method of transmission over the Internet, method of electronic storage or other security methods are one hundred percent secure. Therefore, while Animaker Academy strives to protect Learner's PII, We cannot guarantee its absolute security.
Animaker Academy shares limited access to Learner's PII with its employees, in order to provide relevant information to Learners. However, such privileged access comes with strict controls and logs monitoring the employee’s use.
Data Retention
Animaker Academy may retain Learner's PII:
As necessary to support Animaker Academy.
To comply with Animaker Academy’s own legal obligations.
To resolve disputes.
Any Content posted by Learners, may remain on Animaker Academy, even after the Learner ceases using Animaker Academy or even after Animaker Academy terminates their access to Animaker Academy’s Services.
Learners Under the Age of 13
Animaker Academy is not for use by Learners under the age of 13.
Animaker Academy will not and does not ask for, or knowingly collect any Data from Learners under the age of 13.
Visitors to Our Website under the age of 13 or Younger, will not be required to disclose their personal data.
Student Learners under the age of 13 accessing Animaker Academy and/or any other subdomain, under the direction of a school project, will have to provide the contact details of their teacher, rather than their own personal data.
If You are under the age of 13, You should not attempt to send or send any Data, including, but not limited to, about Yourself to Animaker Academy, including Your name, address, telephone number, or email address.
If You are a parent or legal guardian or teacher of a Learner under the age of 13 and believe that Animaker Academy might have any Data from or about a Learner under the age of 13, please contact our Support Team. In the event that We become aware by confirmation, that We have collected any Data from any Learner under the age of 13, We will delete that Data promptly and inform You of the details.
Changes to Animaker Academy's Privacy Policy:
Animaker Academy reserves the right to change its Privacy Policy at any time.
